It is very important to us that YOU, who use the NDD PRINT MPS / NDD PRINT 360 / NDD ORBIX product(s), read this Privacy Notice carefully.
The main purpose of this Privacy Notice is to demonstrate the ways in which NDD treats and uses information that allows the identification of a person (“Personal Data”), which may be provided by YOU, by an NDD CLIENT and/or automatically collected by SOLUTION.
BE AWARE: It is possible that some people, as a result of the professional activity or contracted service, have access to some specific features and services, not available to conventional Users.
For these cases, there may be notices, terms of use, service agreements, and specific policies. Therefore, in the event of conflicts between these documents, intended for special types of visitors, the provisions of the specific documents will always prevail.
In order for our language to be clear, avoiding confusion of words and expressions, here are some definitions for YOU to understand:
Regulation (EU) 2016/679: General Data Protection Regulation in force in Europe since 25 May 2018 and regulating the processing of personal data in all member states to harmonize data privacy laws across Europe.
PERSONAL DATA: any and all information that allows the identification of a person.
PROCESSING OF PERSONAL DATA: Any operation carried out with personal data, such as those related to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, elimination, evaluation or control of information, modification, communication, transfer, dissemination or extraction;
PERSONAL DATA SUBJECT: You, user of the NDD PRINT MPS/NDD PRINT 360/NDD ORBIX Product(s).
CONTROLLER: Individuals or legal entities that process personal data, defining its flow from collection to elimination.
OPERATOR: Individuals and legal entities that process personal data on behalf of a Controller.
NDD CLIENT: all companies that use our solutions and infrastructure.
PROVIDER/PARTNER: printing outsourcing company, to whom NDD will grant the non-exclusive license to use the NDD PRINT MPS/NDD PRINT 360/NDD ORBIX software.
NDD PRINT MPS/NDD PRINT 360/NDD ORBIX: digital solutions for effective control and management of the printing environment. Refers to the services offered by NDD, including, but not limited to, websites, web portals for access to solutions, mobile applications, knowledge bases, infrastructure or various content that may be made available.
1. THE OBJECTIVE
1.1. Through this Notice, we at NDD are committed to privacy and security in the treatment of data collected from customers and users of the SOLUTION (“YOU”) and applies to all users of the SOLUTION who have an access account and/or who use it to carry out transactions/transactions.
2. ACCEPTANCE OF THE TERMS OF THIS NOTICE
2.1. By registering and/or using the SOLUTION, YOU fully agree with the conditions set forth in this document and in the Terms of Use.
2.2. If YOU do not agree, It will not be possible for you to use our SOLUTION. If you have any questions, please send an e-mail at any time to our Data Officer NDD, via the e-mail address protecaodedados@ndd.tech.
2.3. It is your sole and exclusive responsibility for any data registered in the SOLUTION, as well as the veracity of the information provided. NDD shall not be liable for this information and shall not be liable for any damages arising therefrom.
2.4. NDD may, when it deems it necessary, carry out the verification of the data provided and request the relevant documents for the verification of authenticity.
2.5. NDD may also suspend or revoke your access to the SOLUTION when it verifies that the data provided is incorrect, untrue or shows evidence of fraud.
3. YOUR PERSONAL DATA AT NDD
3.1. Your data is collected by NDD as follows:
(a) Data provided by YOU – when YOU, the NDD CLIENT or the PARTNERS/PROVIDERS enter your data in the SOLUTION, when contracting and/or using the NDD PRINT MPS/NDD PRINT 360/NDD PRINT ORBIX product(s):

4. PURPOSES OF THE PROCESSING OF YOUR PERSONAL DATA
4.1. All data made available by YOU, by the NDD CLIENT or through the PARTNERS/PROVIDERS in the SOLUTION will be received and stored in a secure environment, in NDD’s database.
4.2. The personal data that we access through the use of each SOLUTION by YOU, are processed for the following purposes:

- Fulfillment of the service agreement with NDD CLIENT or PARTNER/PROVIDER;
- Monitoring of printer activities to manage the printing environment; - Computer monitoring (Geolocation: monitoring the location of equipment - helps in the quick identification of equipment); - Hardware performance monitoring (Orbix); - Support Services. |
4.2.1. In addition to the above purposes, NDD may process your personal data to:
(a) your access to the SOLUTION;
(b) your identification and authentication in the SOLUTION;
(c) compliance with legal and regulatory requirements, as well as for the regular exercise of rights related to the defense of claims of a judicial or governmental nature;
(d) sending YOU emails, messages, and notifications with respect to your use of the SOLUTION;
(e) making improvements to NDD SOLUTIONS;
(f) conducting research;
(g) Storage of Data and Information.
4.3. Access to the data is restricted only to NDD employees, YOU and third parties authorized to provide the service.
4.4. The up-to-date maintenance of your data is your right and YOU may change and/or update the data entered in the SOLUTION, through the SOLUTION itself. For cases where direct change is not authorized, YOU may contact us by calling 34 917 55 52 88.
4.5. All information, including but not limited to any and all information revealed, transmitted and/or disclosed, shall be considered confidential, restricted and proprietary to the party that transmitted it. NDD undertakes not to share the information, except for the fulfillment of this Notice or in compliance with the Contracts and Agreements with NDD Clients, adopting technical and administrative security measures capable of protecting personal data from unauthorized access and from accidental or unlawful situations of destruction, loss, alteration, communication or any form of inappropriate or unlawful treatment.
4.6. The term “Confidential Information” does not include information that:
(a) has been published, i.e. or becomes in the public domain, provided that such publication or publicity has not been occasioned by the fault or interference of NDD;
(b) Subsequent to disclosure herein, is lawfully obtained or may have been obtained from a third party with legitimate rights to disclose the information without any restriction thereto;
(c) Has been independently developed by NDD in conjunction with third parties who did not have access to or knowledge of such Confidential Information;
(d) Are required by competent judicial or governmental order, or for the protection of NDD‘s interests in the event of a conflict, including in lawsuits;
(e) When necessary for NDD’s business activities and provision of the contracted service and/or to improve the service offered by NDD.
5. SHARING YOUR PERSONAL DATA WITH AUTHORIZED THIRD PARTIES
5.1. For your best experience, we have relationships with renowned strategic partners in the national and global market that act under a regime of reciprocal confidentiality, promotion and monitoring of technical and organizational security measures aimed at the security and protection of personal data processed. We share your personal data to achieve the following purposes:

5.2. Be aware that we at NDD do not, under any circumstances, commercialize or share personal data without cause.
5.3. However, in order to optimize our operations and perform our services, we rely on strategic partners. It is important for YOU to know that all of them are carefully evaluated and with whom we act under a regime of reciprocal confidentiality, promotion and monitoring of technical and organizational measures aimed at the security and protection of the personal data processed.
5.4. To promote security to the database processed by NDD, we share personal data with service providers committed to security in the processing of personal data.
5.5. We will only share your personal data with third parties in the following cases:
- NDD‘s technical and security service providers.
- the provider of data hosting and storage services;
- to the client contracting our services; and/or
- whenever we are required to disclose them, whether by virtue of a legal provision, order of any competent Court, Public Authority or Regulatory Body.
6. HOW TO EXERCISE YOUR RIGHTS
6.1. As the Data Subject of the personal data we process, please know your rights:

As a security measure, in order for us to confirm that we are talking to YOU, it is possible that some more information will be requested, preventing us from sharing your information with unauthorized third parties. |
6.2. If YOU accessed our solution through your employer, partner or contractor (NDD Client or Partner), please contact them because they are the ones responsible for transferring your data to this solution.
NDD Tip! Protect your data. Take additional security measures to ensure that YOU are using up-to-date anti-virus and anti-spyware devices and browsers that certify the authenticity of the websites you browse on the internet. Create strong and different passwords, every time.
6.4. If YOU identify something that may have compromised the data that YOU have given us, please contact our Data Protection Steering Committee: comitedeprotecaodedados@ndd.tech.
7. STORAGE AND SECURITY OF INFORMATION
7.1. The storage of personal data processed by NDD and inserted in the SOLUTION takes place on cloud servers contracted by third parties or its own, located in Europe.
Your personal data is stored only for as long as necessary to fulfill the purposes for which it was collected, unless there is any other reason for its maintenance, such as, for example, compliance with any legal, regulatory, contractual obligations, the regular exercise of rights, all of which are always based on a clear and specific purpose.
7.2. YOU are aware that the deletion of data and/or information from the SOLUTION will make it impossible to use it.
7.3. NDD uses technical and organizational security measures aimed at the protection of personal data processed, through technologies practiced in the market, in addition to the continuous training of its employees.
8. GENERAL PROVISIONS
.1. In the event that any provision of this Notice is deemed null and void, such decision shall not affect the validity of the remaining provisions, and this instrument shall continue to be in force and produce effects as if the invalidated provisions had never been included therein since its execution.
8.2. Any tolerance of NDD, in the face of non-compliance with any rights or obligations agreed in this Notice, will not constitute novation, but mere liberality of NDD.
8.3. This Notice may be amended at any time, at NDD’s discretion, as a result of legislative changes or changes in the content of the SOLUTION, etc.
8.3.1. NDD undertakes to make available the updated version of this document on the website <https://ndd.tech/politica-de-privacidade-solucoes/>.
8.3.2. All rules, conditions, obligations, as well as all other provisions contained in this Notice, shall be governed by the laws in force in Europe, in particular Regulation (EU) 2016/679 (General Data Protection Regulation)
